The Movie Club

Jennifer Lawrence in Silver Linings Playbook. Jennifer Lawrence in Silver Linings Playbook

Courtesy The Weinstein Company.

Ugh, Keith, you?re so right about how Oscar season comes along every year and squashes all movie conversations in progress, like that giant animated foot that used to come down and stomp out sketches in progress on Monty Python?s Flying Circus. Judgments of a given film?s value get inextricably tangled up with estimations of its likelihood of winning; our love for one movie or performance becomes tainted by resentment for that other, annoying one that?s getting all the attention instead.

Much as I enjoyed David O. Russell?s Silver Linings Playbook when it came out, I couldn?t help but lift an eyebrow yesterday when it up and became the first movie in 31 years (since Warren Beatty?s Reds) to get nominated for an Oscar in every acting category?not to mention Best Adapted Screenplay, Best Director, and Best Picture. If by some dark miracle of Harvey Weinstein necromancy Silver Linings turns out to be this year?s The Artist?a slight, imperfect, but amusing picture that inexplicably elbows its way past worthier competitors to the Oscar finish line?then yeah, that?ll be irritating. This ungainly comedy is not only not the best picture of the year, it?s not even Russell?s best work. (I still prefer his early, manic, overstuffed farces: Flirting with Disaster, I Heart Huckabees.) But especially after a second viewing (undertaken to test whether I?d unfairly prejudged Bradley Cooper?s performance the first time around, which I think I did), I?m fine with Silver Linings elbowing its way onto so many awards slates. More romantic comedies should be this loose-limbed, this idiosyncratic, and this flat-out funny and sexy and sweet. Sure, Russell?s script is uneven and a little shapeless. The movie seems to sit up halfway through, realize ?Oh crap, I need a climactic resolution,? and then race to provide a rushed, overly tidy one. But much of what comes first is so marvelously untidy that you forgive it a lot. Russell?s moviemaking practice has something in common with the rough wisdom espoused by Jennifer Lawrence?s character when accused by Bradley Cooper?s of being a ?big slut?: ?There?s always going to be a part of me that?s sloppy and dirty, but I like that.?

Silver Linings Playbook is stuffed to bursting with small pleasures. There is Lawrence?s movie-star-making turn as the proudly dysfunctional village bicycle Tiffany, Robert De Niro?s most committed performance in a decade, and all the lovingly established details and rhythms of everyday life in a working-class Philadelphia neighborhood. It?s a very rhythmic film all around, at times recalling Robert Altman in its easy, loping pace and dense overlapping dialogue. And I admire the care Russell invests in the specificity of even the smallest characters: Julia Stiles as Jennifer Lawrence?s tightly wound sister, Paul Herman as Robert De Niro?s omnipresent gambling partner, Chris Tucker as Bradley Cooper?s obsessive-compulsive buddy from the ?loony bin? (the script?s term, not mine). Love it or not, you leave that movie having visited a world.

The same is true of Benh Zeitlin?s Beasts of the Southern Wild, 2012?s Sundance Cinderella, that has floated through the year as if coated in pixie dust. I don?t mean to be sarcastic toward this beautiful, earnest, intermittently affecting film?it?s a hard movie to entirely hate, especially when you see phone footage of 9-year-old Quvenzhan? Wallis dancing at the Critics? Choice after-party in a pink dress. Stephanie and Wesley compare Beasts to a graduate thesis on poverty; to me it was more like a kindergarten ceramics project, lovingly made and offered, but nonetheless lumpy and inexpertly glazed. I think Benh Zeitlin seems like a filmmaker of enormous promise, and I?m glad his movie?s success will give other weird, uncategorizable-by-genre projects like it a chance to get made and seen. But that doesn?t mean his movie isn?t a sodden, unfocused mess.

I feel like I?ve gone through the year having conversations where someone who loved Beasts makes the case for it, I make the case against, and both of us walk away having utterly failed to connect. Precisely what they like about the movie must be what I don?t, I guess: the unswervingly high emotional pitch of the story; the ever-present swelling chords of the pretty folkie score (co-composed and performed by Zeitlin); and that horrible, relentless voiceover. I loved Wallis both as a physical presence onscreen (in those rubber boots and orange undies, how could you not?) and in her scenes with other actors, but I think she was done a disservice by being forced to read aloud reams of florid prose that seemed to be originating from anywhere but her 6-year-old character?s brain. By the movie?s end, I was ready to send the writers? teeth ?flying around the sky in a million little pieces,? or whatever that line is.

When I first saw the trailer for Beasts?that shot with the little girl running through a slow-motion shower of sparks while the music plays in the background?I thought, wow, this looks sensational. Little did I know that the music would never let up, or that that image would appear not at the movie?s emotional climax but somewhere in the first 10 or 15 minutes, or that the whole film would essentially be a string of just such decontextualized bursts of feeling with no dramatic downtime for getting to know the characters or their world. By the second hour I started to feel as if I were watching a tearjerking television commercial for ? what? Poverty? Authenticity? Crawfish boils?

Keith, for this last round (already??), I won?t even throw you a particular title to riff on. I?ll just set you loose in the newly stocked storage room of 2012 movies. Which ones do you want to pick up, dust off, and turn over again, just for the feel of them in your hands?

2013 Sony Open: First Tee grad Scott Langley leads at Waialae

Scott Langley had a heck of an introduction to the big leagues. Not only did the lefty play his first game as a member of the PGA Tour on Thursday, but he fired a flawless opening-round 8-under 62 Friday to take an early one-shot lead over a field that includes last week?s winner Dustin Johnson, U.S. Open champ Webb Simpson, and a slew of other decorated tour veterans.

Langley, the first graduate of The First Tee program to earn a tour card, posted six birdies and an eagle to steal the show from playing partner and fellow rookie Russell Henley, who will start Friday?s second round a shot back.

Langley heads up a class of 23 tour first-timers playing in the first full-field event of the 2013 season. He?s finished tied for low amateur at a U.S. Open (2010) and won on the Nationwide Tour as an amateur and twice last year as a pro. An accomplishment he may be proudest of, however, is his standing as the first alumnus of The First Tee program to earn a tour card.

?It's an honor to represent them, and I think it's really cool that the First Tee is getting a presence out on tour,? Langley told reporters Wednesday. ?It's a great organization, and it taught me a lot when I was younger.?

A program dedicated to teaching juniors core values through golf since its inception in 1997, The First Tee is a project of the PGA and LPGA Tours, the PGA of America, and the USGA, among other backers. More than 6.5 young people have participated in the activities of the organization, which boasts 10,000 active volunteers, 5,100 elementary schools, and offerings in all 50 states plus four international locations.

Langley, a University of Illinois All-American golfer, finished tied for 17th at Q-school. Last year at this time, he and good pal Henley were grinding it out on the Hooter?s Tour and he could barely contain his excitement to be playing in paradise.

"He had just missed the cut, I barely made the cut, we were on the range trying to help each other find it," Langley said. "We were just walking up 16. You could see the ocean behind, PGA Tour signs everywhere. We looked at each other and realized this is pretty cool, to look back one year ago and to know that we weren't here. We were in a far different place."

Langley, who credited Henley and a couple of other close friends with helping him through some lean times, looks up to Rickie Fowler as something of a mentor. Fowler took Langley under his wing last year and even provided housing for him and two other newbies in the field this week, Morgan Hoffman, and Cameron Tringale.

?Rickie was great. Kid has a heart of gold,? said the youngster about the popular golfer one year his senior. ?He became one of my closest friends living in Jupiter, kind of going through a tough time personally and he really helped me out with staying at his house.

?Morgan Hoffman and Cam Tringale and Rickie are some of my closest friends to this day, and in large part to me living there with those guys,? Langley said. ?Last year, I can really point to some areas in my golf game that were really improved just by being around Rickie and being around Cam and Morgan. They?re such competitors, and there?s so much good confidence, the right kind of confidence, and I really fed off that living in the house."

Langley may have been wide-eyed in his professional debut, but the 23-year-old exhibited wisdom beyond his years when he observed that he was far from hoisting the hardware.

"I'm a young guy, but I'm old enough to know that we have a lot of golf left,? he said. ?We've barely started, and I'm excited about the next few days.?

Transeuro Energy shares rise on December gas production from Beaver River field

. () saw its shares rise more than 40 per cent Monday after it said December gas production from the Beaver River field in Canada increased substantially.?

December gas production from the the field was 1,314,960 cubic metres, or an average of 42,418 cubic metres per day, compared to November production of 782,230 cubic metres or an average of 26,074 cubic metres per day.?

Output last month was reduced for the first 10 days due to high pipeline pressures after the November plant shutdown that contrained field compressors at the time. The compressors have since returned to the long-term trend, the company said.

Transeuro believes there is significant value at its Beaver River shale asset in Canada despite the low natural gas prices there.

The company said earlier in December that it received farm-in interest from several parties and intends to pursue these ?with commitment and strong resolve?.

It came as the board met to address the challenges it faces while a review of the Ukraine operations and negotiations with the government regarding the licence and joint activity agreement are being finalized.

?Combined with lower industry drilling and equipment costs the company believes there is a window of opportunity to develop this asset [Beaver River] to a significant play,? the statement read.

?The existing acreage together with nearby opportunities constitutes the immediate focus for shareholder value.?

The company said a variety of projects have been reviewed over the past few months and it will concentrate its efforts on three options: its Beaver River asset, its Ukrainian operations, as well as a number of ?distinct oil projects?.

The company said its Ukraine operations need a strong joint venture model and tight co-operation with local partners and the government. The board wishes to go ahead with the licences with suitable financial partners, it also told investors.

Transeuro added that the board is guiding the management team ?with a sense of urgency? and has set a target of three to six months to make headway on the options or even conclude them.

Shares in Transeuro were higher this morning, lately changing hands at 3.5 cents.?

2003 Ford Mondeo Ghia Estate/Turnier from Germany

Before I get into details about what is wrong with the car, I just wanted to say that I bought this car when it was 4 1/2 years old (6 months after warranty expired), and the car was maintained properly, as it was stated in the service book.

Had a clang noise when changing from 3rd to 4th gear, and when engaging in first gear. Thought that it was DMF, changed it, with the whole clutch assembly, but the problem persisted. Don't know what is it. My friend bought a new Mondeo same as mine, and at 80000 km it is starting to show the same symptoms.

At full throttle the car kinda stalls at 2700-3200 RPM. I was told that the fins on the turbo (variable geometry) are a little jammed, so it is not opening correctly. Turbo was serviced/ cleaned, but the problem is still there. Not as much as it used to be, but it is still there.

Rattle at steering rack when the car is at idle. Rattle is coming from where the steering rack is connected to the steering column. When I turn the steering wheel, the rattle disappears.

Rattle at dashboard, close to windscreen. I tried to screw it, but it is all tight as it should be.

Rattle at the drivers doors. It is particularly sensitive to acceleration and deceleration. When I accelerate - click, when I brake - click. So annoying!

When I got the car, I saw that almost a third of the windscreen heaters are not working.

Sometimes I cannot open the boot, since the lock when I press the button won't open, so I have to either use a key, or unlock it from the drivers inner commands.

A wobble appeared since 155000. It turned out to be tripod on the drive shafts (inner CV joint), so I had to change both of them. Why do I need to change this at 150000 km?

Self leveling on the lights (xenon), are not working most of the time. My lights are permanently down. One day they just move to the correct position by themselves.

Almost all of the doors had rust at their bottoms. I have a signature'd service book stating that the car what rust-free. What? How can the Ford dealer miss this? Probably they did not wanted to replace it under warranty.

My rear right brake caliper is jamming, and I can feel that the car is slowing rapidly, and the tyre rim can be very hot.

California school shooter talked into surrendering by heroic staff

A gunman who opened fire on students at a Californian high school was talked into surrendering by two ?heroic? staff members, it has emerged.

The 16-year-old gunman walked into Taft Union High School in Bakersfield yesterday morning armed with a shotgun planning to shoot two students on a?hit list.

One victim remains in critical but stable condition following the attack by his fellow classmate.

Teacher Ryan Heber helped a number of students get to safety before engaging the shooter in conversation along with campus supervisor Kim Lee Fields.

?They talked him into putting that shotgun down,? explained Sheriff Donny Youngblood. ?He in fact told the teacher, ?I don?t want to shoot you?.

?The heroics of these two people goes without saying. ? They could have just as easily ? tried to get out of the classroom and left students, and they didn?t.

?They knew not to let him leave the classroom with that shotgun.?

Police believe the suspect, who was arrested at the scene, took a shotgun belonging to his brother to carry out the attack.

The suspect alleges the two students he targeted had bullied him for more than a year.

FDA requires lower doses for Ambien, sleep meds

By The Associated Press

The Food and Drug Administration is requiring makers of Ambien and similar sleeping pills to lower the dosage of their drugs, based on studies suggesting patients face a higher risk of injury due to morning drowsiness.

The agency said Thursday that new research shows that the drugs remain in the bloodstream at levels high enough to interfere with morning driving, which increases the risk of car accidents.

Regulators are ordering drug manufacturers to cut the dose of the medications in half for women, who process the drug more slowly. Doses will be lowered from 10 milligrams to 5 milligrams for regular products, and 12.5 milligrams to 6.25 milligrams for extended-release formulations.

The FDA is recommending that manufacturers apply these lower doses to men as well, though it is not making them a requirement.

The new doses apply to all insomnia treatments containing the drug zolpidem, which is sold under brands including Ambien, Edluar and Zolpimist.

FDA officials say doctors should aim to prescribe the lowest dose possible that will successfully treat insomnia.

"Patients who must drive in the morning or perform some other activity requiring full alertness should talk to their health care professional about whether their sleep medicine is appropriate," said Dr. Ellis Unger, a director in FDA's Office of Drug Evaluation.

Unger said in a statement that the FDA has received a number of reports of car accidents connected to zolpiderm over the years. However, the agency did not have enough information to tell how much of a role the drug played in the incidents.

The agency decided to take action after recent driving simulation studies showed that, in some patients, drug levels remained high enough to cause difficulty driving.

For now, patients should continue taking their currently prescribed dose until they can talk to their doctor about the best way to proceed.?

McChrystal: 'serious action? needed on gun control

Retired Gen. Stanley McChrystal said he supports gun control. Speaking on MSNBC?s "Morning Joe," the former commander of U.S. forces in Afghanistan said some weapons should be carried only by soldiers, not civilians.

"I spent a career carrying typically either an M16, and later an M4 carbine," he said. "And an M4 carbine fires a .223 caliber round, which is 5.56 millimeters, at about 3,000 feet per second. When it hits a human body, the effects are devastating. It's designed to do that. And that's what our soldiers ought to carry."

The general added, "I personally don't think there's any need for that kind of weaponry on the streets and particularly around the schools in America. I believe that we've got to take a serious look. I understand everybody's desire to have whatever they want, but we?ve got to protect our children, we?ve got to protect our police, we've got to protect our population. And I think we have to take a very mature look at that."

The general, who had to resign his position as commander of the U.S. Forces in Afghanistan after an unflattering Rolling Stone magazine profile in 2010, is back in the public eye to promote his book, "My Share of the Task."

The former military man supports an assaults weapons ban. He told the show, ?I think serious action is necessary. Sometimes we talk about very limited actions on the edges, and I just don?t think that?s enough.?

Asked what his message would be to the NRA and the House Judiciary Committee, he said, ?I think we have to look at legislation. The number of people in America killed by firearms is extraordinary compared to other nations. And I don?t think we?re a bloodthirsty culture, and so I think we need to look at everything we can do to safeguard our people.?

Reward offered for jewel box taken from museum

(AP) ? The Oakland Museum of California offered a $12,000 reward Wednesday for the safe recovery of a stolen gold-encrusted jewel box ? the latest in a series of thefts involving Gold Rush-era artifacts across the region.

The box stolen Monday depicts images of early California history and was originally a wedding anniversary gift from a San Francisco pioneer to his wife in the 1800s, museum director Lori Fogarty said.

It's the size of a small shoebox and weighs about three pounds.

Oakland city officials have said the box was valued at more than $800,000, but Fogarty said it was difficult to put a price on the artifact.

"It's very difficult to assign value to something like this," she said. "But I can say it's a treasure of our collection and a critical piece in our holdings."

It was the second major theft in as many months from the popular Gallery of California History exhibit at the Oakland museum. Gold nuggets and other historic artifacts were taken in November. Police believe the same culprit may have committed both thefts.

Fogarty said the high price of gold ? which was selling Wednesday at about $1,657 an ounce ? might have prompted the break-ins.

"We don't know if it's related to the value of gold, if that is what the burglar is interested in," Fogarty said. "But that's certainly one of our fears."

Nonetheless, the precious metal appears to have made targets of sites that house historical items. In September, a state mining and mineral museum in the Sierra foothills in Mariposa was robbed of an estimated $1.3 million in gold, precious gems and artifacts by thieves armed with pickaxes.

In February, thieves smashed a lobby display case at the Siskiyou County courthouse and made off with large chunks of gold. Both sites are in California's Gold Country, where people from around the world came in the mid-1800s to strike it rich.

Four people have been arrested and charged in the Mariposa case.

Gold Rush memorabilia and items remain attractive to collectors because of the romance and myth associated with the era, said Gary Kurutz, a special collections curator at the California State Library in Sacramento.

"There are so many great stories associated with it ? the letters, the diaries, the rare books, the prints and of course the actual gold nuggets," he said.

Gold can be melted down, making it easy to fence. But Kurutz said someone would have a harder time offloading a jewel box like the one taken on Monday.

"You would not be able to take it to an auction house or any responsible antique dealer," he said. "They would know immediately that this is hot."

Elsewhere in the nation, about $400,000 in gold pieces were stolen from a museum in New Jersey two years ago, and a gold bar worth about $550,000 was taken from a Florida museum in 2010. That gold had been recovered from the shipwreck of a Spanish galleon off the Florida Keys.

Steve Keller, chair of the American Alliance of Museums security committee, said smaller museums that have gold on display are vulnerable to theft, although he did not include the Oakland museum in that category.

The museums "have sort of never had a problem in the past, so they assume they're not going to have a problem now," said Keller, who has his own security consulting company. "But times have changed."

On Wednesday, Oakland Mayor Jean Quan pleaded publicly for the safe return of the jewel box stolen two days earlier. She said the artifact belongs to the city.

"This is not something you can sell on a street corner," Quan said. "We hope those who will be approached will return it to the people of Oakland. This is a theft not only of a valuable object, but a theft of our history."

It was not the first time the jewel box, which has been associated with the museum since the 1960s, was stolen. Fogarty said it was taken in 1978 and recovered at an auction house several years later.

Police declined to go into specifics about the latest theft, citing the ongoing investigation. Fogarty said the thefts at the museum involved items kept just a few feet apart, and the thief apparently broke in through an entrance near the museum garden.

The jewel box had been in a Plexi-glas case equipped with an alarm that sounded after it was stolen, she said, adding that police arrived in less than five minutes.

Both thefts were caught on security cameras, she added.

After the first theft in November, Fogarty said the museum added extra security guards and cameras.

"Obviously, we'd like our security measures to be better or this wouldn't have happened," Fogarty said. "But we do feel confident with that steps we took were appropriate and the enhanced security measures will aid in this investigation."

Egypt's president to meet Palestinian rivals on unity

CAIRO/GAZA (Reuters) - Egyptian President Mohammed Mursi plans to meet the leaders of Palestinian factions Hamas and Fatah on Wednesday in a renewed effort to help them heal their five-year-old feud, Palestinian and Egyptian officials said.

The officials said Mursi would meet individually with President Mahmoud Abbas of the secular Fatah group and Khaled Meshaal of the Islamist Hamas movement to discuss a stalled reconciliation deal the two agreed in Cairo last year.

Egyptian mediators had hoped to coax them into the same room, but a Palestinian source told Reuters the two will meet later in the evening, without the Egyptian president.

Abbas is reluctant to any format which would imply giving the Hamas leader a status equivalent to his own.

Hamas spokesman Sami Abu Zuhri downplayed the talks in Cairo, describing them as "exploratory."

"Egyptian officials aim to explore where things stand and look into the best ways to activate reconciliation efforts," he told Reuters.

Mursi, grappling with political and economic difficulties at home, helped broker a ceasefire deal that ended a brief war in November between Israel and Hamas, which rules the Gaza Strip.

Leaders of the two groups have been deadlocked over the unity agreement and have traded blame over continued arrests among members in the West Bank, where Abbas holds sway, and in Gaza, which Hamas wrested from Abbas's control in 2007.

On Tuesday, a Hamas court sentenced a senior Fatah armed activist, Zaki al-Sakani, to 15 years in prison for possession of arms, according to Hamas security sources. A Fatah official described the verdict as a blow to reconciliation.

THAW IN RELATIONS

The Palestinian rivals have drawn closer since Israel's assault on Gaza in November, in which Hamas claimed victory, and a diplomatic win by Abbas the same month in which the United Nations voted to recognize Palestine as a "non-member state."

Supporters of the two factions were allowed to hold anniversary rallies in Gaza and the West Bank for the first time since their split, though the celebrations produced no concrete signs of how reconciliation might be implemented.

Last year's Egyptian-drafted agreement called on both sides to form a unity government that would oversee an election and reform the Abbas-led Palestine Liberation Organisation to include Hamas and the less influential Islamic Jihad group.

Abbas says Hamas is obstructing election registration in Gaza, while Meshaal says the pact needs to be implemented as a whole, with Hamas prisoners in West Bank jails released.

A senior Hamas official in Gaza accused Abbas of dragging his feet on reconciliation and slowing its pace because he was still hoping for a renewal of stalled peace talks with Israel.

"Our information showed that President Abbas would head towards reviving negotiations with the occupation (Israel) when the election in Israel is finished," Salah al-Bardaweel said in a statement.

Israel will hold a parliamentary election on January 22.

It has criticized Palestinian unity efforts, fearing grassroots support for Hamas, deemed a terrorist group by the Jewish state and Western governments, could overwhelm Abbas's administration, which has long renounced violence against Israel.

Hani Habib, a political analyst in Gaza, said the Cairo talks, like previous meetings, had little chance of success.

"The talks today were meant to show something regarding reconciliation is happening but there will be nothing new," he said. "Each side has been unable to twist the other's arm and therefore each is happy with the status quo."

If you?re having trouble dealing with anxiety in public, try going to the movies with a friend. This activity will force you to be around others, but you do not have to talk to them very much, which will minimize your discomfort. It also helps you feel comfortable around crowds.

TIP! Act with your core values in place. Every person?s identity rests on a set of beliefs that are vital to them.

Stay organized and keep up with how you are doing. By taking a large goal and breaking it down to more manageable segments, you will see that completing your goals has become easier. Keep a journal of your daily progress. You will see how these small steps add up toward reaching your goal.

Having a strong sense of self discipline, can really help you excel in achieving your self improvement goals. Learn to develop a strong sense of self control. You can conquer many desires such as lust, drunkenness, or greed. Being able to control your desires and restrain your urges will keep you from harming your mind and your body.

TIP! If your goals are realistic, you will be more likely to reach them and build a life that works for you. Figure out what you do and do not do well, and you will learn a lot about yourself.

Get to know what habits successful people have, and then incorporate them in your lifestyle. Begin with a few basic habits, and work on them until they are second nature. It can take up to three weeks to acquire a new habit, so it is important to keep trying.

Many people starting on a self improvement journey struggle because their goal is too vague and unspecific. Create specific goals. If you create a clear goal, you will achieve the results you want.

Even if you feel the need to change and grow, you will not do so until you choose to. Accepting change will allow you to grow on your path to self development.

TIP! When you?re trying to improve yourself, failure can be a terrible hit to your self-esteem. The good news is that failure can be an enlightening learning experience.

Make sure you are constantly seeking new ventures. These new challenges can open you up to new possibilities. Perhaps you will gain some knowledge or a new skill. You can set the bar for something that no one had ever accomplished. Do what you want to do, rather than what others do.

Are you having a hard time meeting that special someone? Try the Internet. These days, 40 percent of couples meet via the Internet. Your soul mate might be out there looking online for you too. Both have their advantages and disadvantages.

Are you causing yourself unnecessary stress? Analyze your situation with care and manage stress. You?ve probably made mistakes, but you can find ways to fix it, or even live with it. Successful people know that learning from your mistakes, and not simply the fact that you?ve made mistakes, is the key.

TIP! A new trait called sexual capital is currently being researched and encouraged for development. This isn?t about sexuality, but rather about personal charisma.

To achieve success, list personal development goals that are broken down into specifics. With your specific goals, success can come. By breaking down large goals into more manageable ones, you will be more likely to achieve them.

You need to care for yourself before you can care for others. Always give yourself a chance to renew your energy and restore your mind.

Attaining well-being begins with supporting your body?s needs. Listen to what your body is saying to you, so if it is exhibiting hunger, thirst, etc., then it?s up to you to rectify that situation quickly. By doing that, your body will perform better later on in the future. Treat your body well, and it will treat you well right back.

Building an effective self improvement routine is not, as you might now agree, all that tough. Make a better life for yourself, and you?ll be so much happier.

Embattled Michigan Supreme Court judge to quit amid ethics probe

(Reuters) - A Michigan Supreme Court justice announced plans on Monday to step down from the bench after a judicial watchdog accused her of "blatant and brazen" ethics violations in a series of real-estate deals and filed an emergency petition for her suspension.

Attorneys for Justice Diane Hathaway, who is already the target of a federal complaint alleging mortgage fraud, informed the court on Monday she would resign effective January 21, according to a Michigan Supreme Court spokeswoman - nearly four years before her term expires.

The attorneys told the court that Hathaway, who was elected to the high court in 2008, would recuse herself from all official business until then, the spokeswoman said.

In a statement, Michigan Attorney General Bill Schuette said he expected Governor Rick Snyder to quickly appoint a successor.

The announcement of Hathaway's pending resignation came after the Michigan Judicial Tenure Commission filed an 18-page complaint against her with the Michigan Supreme Court, accusing her of fraudulently concealing assets when she and her husband sold a home in the Detroit suburbs in 2011 in a so-called "short sale."

The complaint alleges the couple lied to their lender when they sold the property for about $600,0000 less than they owed on it and, citing financial hardship, persuaded the bank to forgive the outstanding loan principal.

The commission said Hathaway and her husband engaged in a series of sham transactions, temporarily transferring other properties they owned to relatives to hide assets from the bank.

One of those deals, the sale of a property in Windermere, Florida, with an assessed value of $664,682 to Hathaway's stepdaughter for $10, has drawn scrutiny from federal prosecutors.

In November, they filed a civil forfeiture complaint against Hathaway and her husband in federal court in Florida, seeking forfeiture of the Windermere home.

In the complaint, prosecutors allege Hathaway and her husband "systematically and fraudulently transferred property and hid assets" to support the claim they could not pay off the mortgage on the home in suburban Detroit.

"Given the gravity of ongoing federal allegations and today's unprecedented Judicial Tenure Commission complaint, it is in the people's best interest that Justice Hathaway step down," State Attorney General Schuette said in a statement.

Before being elected to the Michigan Supreme Court, Hathaway, a Democrat, served for 16 years as a judge on the Wayne County Circuit Court.

A call to Hathaway's attorney, Steve Fishman, for comment was not immediately returned on Monday.

But in a response to the federal complaint in the fall, Fishman said Hathaway and her husband relied on the advice of an attorney during the short sale process and that the bank either did know or should have known about the property transfer.

Shortly after the short sale of the Detroit property, Hathaway's stepdaughter transferred the Florida property back to the couple for $10.

Hathaway and her husband have not been charged with any crime.

Key account sales training | Sales Training Connection

Key Account Executives Sales Training

?Key Account? is a label used differently across companies, let?s define the term.? Here we are talking about very large accounts, like National Accounts.? In this post, we are focusing on companies who have a separate Key Account sales team.

Over the years we have had the opportunity to design sales training initiatives for numerous companies having Key Account sales teams.? We have learned a couple of important walk-a-ways.

  • Key Accounts are not just big little accounts ? they are qualitatively different on a wide range of parameters related to what they sell and how they sell.
  • They have a tremendous impact on revenue generation and optimization of profits.
  • Success in the Key Account arena requires not just great account executives but also the total support and commitment of the organization.
  • The skill set required of Key Account sales executives is not just more of the same as compare to the one for territory sales people.

One additional insight relates to the nature of the sales training.? Because Key Account sales are more complex and the skill set is more extensive, the sales training should be different than that for territory sales reps. Let?s take a look at that difference.

As context for the sales training discussion, the Boston Consulting group provide some interesting insight in an article entitled Creating Value in Key Accounts.

The authors start out by examining some of the common mistakes in key account management.? They note: the right accounts?those with the highest upside?are often not designated as ?key.? Second, too many accounts are designated key. Three, key account relationships are too often transactional rather than strategic. And four, as a result of the first three mistakes, in the accounts that are considered key, opportunities for joint value creation with the customer are frequently lost.

On the other hand, they go on to point put that getting this whole thing on track can have a significant positive impact.? Through effective key account management ? ?companies can generally lift revenues by 5 to 10 percent, improve margins by three to five percentage points, and lower the cost to serve by 10 to 20 percent.?

Moral of the story ? getting this right matters.? One aspect of getting it right is sales training.? From our evaluations five considerations seem particularly important for achieving effective key account sales training.? As a baseline it?s critical to recognize sales training for key account executives is necessary.? Just because the folks selected for the job are experienced and skilled, does not negate the need for training.? Here are five insights gained from our experience:

  • Design customized programs. There are a variety of reasons to customize sales training. First, the skill sets requiring attention are specific to this level of sale.? Second, the customer issues and challenges are specific to key accounts and to the specific customer base.? Last, the specifics of the sales process for Key Accounts are unique to each company.
  • Adjust the practice and feedback equation. In standard sales training a fair amount of time is devoted to getting sales ideas and tools on the table.? In Key Account training the participants already know the basic selling models and techniques.? The purpose of this training is about how to adjust and adapt the techniques to a complex set of challenges and issues.? So the key is minimizing lecture and maximizing practice and feedback ? at least 85% of the classroom time should be devoted to practice and feedback.
  • Change the instructional model. In most standard sales training programs a single sales trainer conducts the program ? fair enough.? But as the saying goes ?it?s both the dance and the dancer.?? So it is important not only to adjust the program design and content but also who does the sales training.? The best suggestion is substitute a faculty comprised of senior sales managers and outside experts for the single sales trainer.? The faculty is responsible for managing the program and for providing feedback at the strategy and call execution levels. ?
  • Train as a team. If you are going to sell as a team, you ought to train as a team.? Key Account sales almost always involve multiple players such as: engineers, technical support, implementation managers etc.?? Consequently, it makes fair sense that groups of Key Account account executives and support personnel go through the program as a team.? The payoffs, above and beyond the skill development, related to who should be doing what and why are substantive.? If coordination mistakes occur in the heat of battle during the sales process, the consequences can be devastating.
  • Change the investment formula. Although it is unwise to say cost doesn?t matter, sales training for Key Accounts comes as close as you are going to get to that proposition in the sales training domain.? Will this ?training cost more than traditional sales training ? probably, but not that much more?? More importantly if you just close one Key Account deal or expand the scope of another, the investment will have paid off.? A related investment consideration is how often should you doing such training.? Given the dynamic nature of most markets, once every year is probably about right.

Key Account selling is a demanding and skilled task.? The payoffs of getting it right are extensive and significant.? Sales training is only one small piece of the success puzzle but it is a piece for which the dos and don?ts are known.? So not doing it is an error of omission.

Samsung debuts T9000 refrigerator with LCD and Evernote integration

Refrigerators with touchscreens haven't made much of a dent in the American home, but they're certainly a staple at CES. Samsung's latest entry, the rather large 32 cubic-foot four-door T9000 LCD, isn't exactly new territory for the company. At 2011's show the the RF4982 showed what was possible with an 8-inch display and a few productivity apps, but the 9000 adds some much needed versatility by integrating Evernote into the Linux-based OS. The connected household can quickly update a shopping list when looking in the fridge or pull up recipes to reference while milling about the kitchen. It also goes big by moving up to a 10-inch panel. Sadly Samsung has not announced pricing or availability yet for the LCD version, but the touchscreen-less edition of the T9000 will set you back a rather jaw-dropping $4,000 when it ships this spring. For more check out the PR after the break.

Hagel nomination unnerves some in Israel

JERUSALEM (AP) ? President Barack Obama's nomination of Chuck Hagel as the next U.S. secretary of defense is causing jitters in Israel, where some circles view the former Nebraska senator as unsympathetic or even hostile.

Hagel's positions on Israel's two most pressing foreign policy issues ? Iran's nuclear program and relations with the Palestinians ? appear to be at odds with the Israeli government, and critics here fear the appointment could increase pressure on the Jewish state to make unwanted concessions. The appointment could also signal further strains in what is already a cool relationship between President Barack Obama and Israeli Prime Minister Benjamin Netanyahu, who is expected to win re-election later this month.

"Because of his statements in the past, and his stance toward Israel, we are worried," Reuven Rivlin, the speaker of the Israeli parliament and a member of Netanyahu's Likud Party, told The Associated Press. But, he added, the strategic partnership between the U.S. and Israel is strong and "one person doesn't determine policy."

Netanyahu's office refused to comment on the appointment, as did officials in the Israeli foreign and defense ministries. But Rivlin's comments reflected what has been a common sentiment among analysts and commentators here in recent days. In their evening news broadcasts, Israel's three main TV stations on Monday all portrayed Hagel as cool toward Israel.

Known as a maverick in the Senate, Hagel has raised eyebrows in Israel with a series of comments and actions over the years that some here have deemed insufficiently supportive of the Jewish state.

Hagel once said "the Jewish lobby (in the United States) intimidates a lot of people here" and does some "dumb things" that aren't "smart for Israel." He also said that "I'm not an Israeli senator. I'm a United States senator."

"I support Israel, but my first interest is I take an oath of office to the Constitution of the United States, not to a president, not to a party, not to Israel," he said.

Six years ago, he refused to sign a letter pressing the European Union to declare the Lebanese Hezbollah guerrilla group a terrorist organization.

Hagel's call in a bipartisan letter in 2009 for a 'pragmatic' approach toward Hamas, the Palestinian militant group that rules the Gaza Strip, has also drawn criticism. The letter called for engaging Hamas to moderate its behavior, though it said direct U.S. engagement "may not now be practical." Critics, pointing to the letter, have accused Hagel of supporting dialogue with Hamas.

The 66-year-old Hagel, who faces a tough confirmation battle in the Senate, also has criticized discussion of a potential military strike by either the U.S. or Israel against Iran, and has backed efforts to bring Tehran to the table for future peace talks in Afghanistan.

While Hagel's positions on these issues are shared by many in Israel itself, including Netanyahu's own critics, they run counter to those of the Israeli prime minister and could antagonize him if, as polls forecast, he wins a new term in Israel's Jan. 22 elections.

Netanyahu has identified the Iranian nuclear program as his top priority. Convinced that the Islamic Republic is trying to develop a nuclear bomb, a view shared in many capitals around the world, Netanyahu says Tehran must be stopped. Iran says its program is only for peaceful purposes.

While voicing hope that international diplomatic pressure will halt the Iranian program, Netanyahu has said that the use of force must be seriously considered as well. Netanyahu has repeatedly threatened to attack Iran, unilaterally if necessary, if he concludes that diplomacy has failed.

Israel also considers Hamas and Hezbollah to be terrorist groups, although it has held indirect cease-fire talks with both organizations. Israel refuses any direct talks with Hamas, which recently battled Israel during eight days of fighting in November, unless the group renounces violence and explicitly recognizes Israel's right to exist.

Ahead of Hagel's appointment, White House officials tried to play down such differences, saying his positions on Israel and Iran have been misrepresented and that he will be "completely in line with the president." They said that in the Senate, he voted in favor of billions of dollars of military assistance to Israel and supported multilateral sanctions on Tehran.

Despite such promises, the Hagel appointment is likely to fuel the common perception in Israel that Obama does not share the warmth toward Israel held by his predecessors.

In part, that impression stems from the relationship between Obama and Netanyahu. The two leaders took office just months apart in early 2009, and from the beginning, have appeared to be at odds both on the personal level and on key policy issues.

The men have sparred over Israeli settlements in the West Bank and east Jerusalem, the borders of a future Palestinian state and the Iranian nuclear program. Last year, Obama rebuffed Netanyahu's calls to set "red lines" that would trigger an attack on Iran. The perception here that Netanyahu favored Mitt Romney in the U.S. presidential election ? an allegation denied by Netanyahu ? has further strained ties.

The U.S. is Israel's closest and most important ally, and the relationship is critical for Israel. Further cracks in the ties could make for a stormy second term for Netanyahu.

The one area where relations have remained strong is in security ties. The Israeli and American defense establishments cooperate closely in monitoring the Iranians, military training and weapons development. Israel's new "Iron Dome" rocket-defense system, which performed well during the recent fighting in Gaza, was developed with American financial aid.

Speaking at an event for mostly North American Jews in Jerusalem on Monday, Netanyahu thanked the U.S. for its support.

While he did not mention Hagel directly in his speech, Netanyahu he did warn of dangers ahead ? including Iran's nuclear program ? and said "it is time for many who don't see these dangers to wake up to them."

Eytan Gilboa, a specialist on U.S.-Israel relations at Israel's Bar-Ilan University, said he thinks if Hagel "will be a total disaster for Israel."

He said Obama's choice for CIA director, John Brennan, is considered good for Israel and could be a "stabilizing factor" on U.S. policy toward Israel. But overall, he said Obama's foreign policy team creates a "potential recipe for many problems with Israel."

"Obama is sending a message to Israel that rough times are ahead and if it doesn't accommodate U.S interests, there will be tense relations," he said.

But Dov Weisglass, who served as a top adviser to former Prime Minister Ariel Sharon a decade ago and was involved in sensitive dealings with the Americans, said concerns about Hagel are overblown.

"Ties between countries are not decided by this person or that. The ties between Israel and the U.S. are so important and complex that I don't see any reason why they should change,' Weisglass said, predicting that in his new role, Hagel would, generally speaking, revise his outlook on things.

What's more, "ultimately, he is not the only decision-maker," he said.

Vizio debuts its first Windows 8 tablet, an 11inch slate with a 1080p display, AMD processor

After breaking into the PC market last year, it was only a matter of time before Vizio released its first Windows 8 tablet. The company just announced the Vizio Tablet PC, an 11.6-inch slate running full Windows (i.e., none of this RT business). What's interesting is the combination of specs here: on the one hand, it packs a dual-core, 1GHz AMD Z60 chip, making it among the first Windows 8 tablets with an AMD processor inside. At the same time, it rocks a 1080p display -- not the sort of resolution you'd expect to find on a low-power tablet with a Z-series or Intel Atom CPU. Also, like the rest of Vizio's PCs, this has a Microsoft Signature software install, with zero bloatware. Otherwise, the specs are pretty standard: 2GB of RAM, 64GB of solid-state storage, a 2-megapixel front camera and micro-HDMI / micro-USB ports. Vizio hasn't announced pricing or exact availability just yet, but we hope to get hands-on with this thing very, very soon.

Chavez ally elected, could be caretaker leader

Leo Ramirez / AFP - Getty Images

The president of the Venezuelan National Assembly, Diosdado Cabello speaks outside the National Assembly in Caracas on Saturday. He was elected Assembly chief on Saturday as President Hugo Chavez recovered from another cancer surgery in Cuba.

By NBC News and wire services

Venezuelan lawmakers re-elected a close ally of President Hugo Chavez as Assembly chief on Saturday, paving the way for him to become a caretaker president if the socialist leader does not recover from cancer surgery.

Diosdado Cabello, a combative ex-soldier, was cemented by the ?Chavista?-dominated legislature as the third most powerful figure in government, behind Chavez and Vice President Nicolas Maduro.

"As a patriot ... I swear to be supremely loyal in everything I do, to defend the fatherland, its institutions, and this beautiful revolution led by our Comandante Hugo Chavez," Cabello said as he took the oath, his hand on the constitution.?

Chavez was elected in 1999 and was among the first of the so-called ?pink tide? of elected leftist leaders in Latin America. He allies himself with the Castro regime in Cuba, President Daniel Ortega in Nicaragua and Evo Morales in Bolivia.?

In the last 18 months, Chavez, 58, has undergone four surgeries in Cuba, where he is currently recovering. On Thursday, the Venezuelan government said he was suffering from a ?severe? respiratory infection that hindered his breathing.?The Venezuelan leader has not been seen in public for more than three weeks.

Hours before the vote to re-elect Cabello, thousands of Chavez supporters clad in red gathered, chanting: "We are all Chavez! Our comandante will be well! He will return!"?

If Chavez had to step down, or died, Cabello would take over the running of the country as Assembly president and a new election would be organized within 30 days. Chavez's heir apparent, Maduro, would be the Socialist Party's candidate.?

The opposition says Chavez's absence would be just the latest sign that he is no longer fit to govern. Cabello slammed their criticism.

"Get this into your heads," he shouted. "Hugo Chavez was elected president and he will continue to be president beyond Jan. 10. No one should have any doubt." His fellow Socialist Party lawmakers cheered.?

The opposition, who had days before demanded details of the president?s health, sat stony-faced. One of their legislators had earlier told the session that it was not just the head of state who was ill: "The republic is sick," he said.?

ROME (AP) ? Rescue crews used boats and aircraft on Saturday to search for a small plane that disappeared in Venezuela carrying the CEO of Italy's iconic Missoni fashion house and five other people.

But 24 hours after the BN-2 Islander aircraft disappeared from radar screens on its short flight from Venzuela's coastal resort island of Los Roques to Caracas, the capital, no sign of the plane had been found, officials said.

"We have no other news" about the plane carrying Vittorio Missoni, the head of the company; his wife, Maurizia Castiglioni; two of their Italian friends; and two Venezuelan crew members, said Paolo Marchetti, a Missoni SpA official. He spoke briefly to reporters as he left company headquarters in the northern Italian town of Sumirago on Saturday afternoon.

Missoni's younger brother, Luca, who is active in the family-run business, was reportedly traveling to Venezuela on Saturday to monitor search efforts.

"We're holding onto a glimmer of hope," said Oswaldo Scalvenzi , a relative of Elda Scalvenzi, one of the Missoni friends aboard the flight. "Until we can see the wreckage" hope will remain, Scalvenzi told Italian state TV on Saturday night.

The La Repubblica.it, website of the Rome newspaper said Venezuelan aircraft, motorboats and helicopters took off at dawn Saturday to resume the search for the missing plane, which had been suspended on Friday night. The Italian news agency ANSA, reporting from Rome, said a specialized ocean-searching naval vessel also was being deployed.

Vittorio Missoni is the eldest son of the company's founder, Ottavio, who at 91 still follows the business.

The Corriere della Sera newspaper reported that Ottavio and his wife Rosita were at their home in Italy, along with their daughter Angela, creative director of the company, waiting for information about the search. Rosita Missoni designs housewares for the company, and Angela's daughter, Margherita, has been infusing its classic designs with fresh appeal.

The Missoni fashion house, with its trademark zigzag and other geometric patterns in sweaters, scarves and other knitwear, is one of Italy's most famous fashion brands abroad.

Vittorio Missoni played a key role in marketing the Missoni family creations in Asia, especially in Japan, Hong Kong and South Korea as general director of marketing for Missoni SpA. He also spearheaded a push for the company's products in the United States and France. His efforts to expand the brand abroad led Missoni to be dubbed the company's "ambassador."

On Friday, Venezuela's Interior Minister Nestor Reverol said the plane was declared missing hours after taking off from Los Roques, a string of islands popular for scuba diving, white beaches and coral reefs, and where the Missonis and their friends were on vacation.

Vittorio Missoni has been described as an active sportsman and lover of the outdoors. He and his wife and their friends from northern Italy were scheduled to fly back to Italy on Friday, but their internal flight never made it to Caracas.

La Repubblica said the plane disappeared off radar screens shortly after takeoff from Los Roques on what was to been a 90-mile (140-kilometer) flight to the mainland.

The Missoni brand is scheduled to display its latest menswear creations at a fashion show in Milan later this month.

On Jan. 4, 2008, another plane returning to the Venezuelan mainland from Los Roques disappeared with 14 people aboard, including eight Italians. The body of the plane's Venezuelan co-pilot later washed ashore, but despite a search lasting weeks no other victims or the wreckage were found.

In 2009, a small plane returning from Los Roques with nine people aboard plunged into the Caribbean Sea, but all survived.

Lance Armstrong may admit he used banned drugs: NY Times

(Reuters) - Lance Armstrong, the American cyclist at the center of the biggest doping scandal in the sport's history, may admit he used performance-enhancing drugs during his career, the New York Times reported in Saturday's editions, citing unidentified sources.

Such an admission would be a stunning reversal for Armstrong, who has vehemently denied doping for years.

The Times reported that Armstrong, 41, has told associates and anti-doping officials he may make the admission in hopes of persuading anti-doping officials to allow him to resume competition in athletic events that adhere to the World Anti-Doping Code, under which Armstrong is currently subject to a lifetime ban.

Asked if Armstrong might admit to doping, Armstrong's lawyer Tim Herman told the Times: "Lance has to speak for himself on that."

The newspaper, citing an unidentified person briefed on the situation, said Armstrong has been in discussions with the United States Anti-Doping Agency (USADA) and met with Travis Tygart, the agency's chief executive.

The paper, citing the same source, said Armstrong is also seeking to meet with David Howman, the director general of the World Anti-Doping Agency.

Armstrong's lawyer denied his client had talked with Tygart, according to the Times.

Howman said in a statement the agency had read "with interest" media accounts of Armstrong's possible intention to confess.

"To date, WADA has had no official approach from Mr. Armstrong or his legal representatives, but - as with anyone involved in anti-doping violations - it would welcome any discussion that helps in the fight against doping in sport," Howman said.

A spokeswoman for the USADA declined to comment.

An October 10 report from the USADA citied Armstrong's involvement in what it characterized as the "most sophisticated, professionalized and successful doping program that sport has ever seen," involving anabolic steroids, human growth hormone, blood transfusions and other doping.

Less than two weeks later, Armstrong's seven Tour de France victories were nullified and he was banned from cycling for life after the International Cycling Union ratified the USADA's sanctions against him.

Wealthy supporters of Livestrong, the charity Armstrong helped found, have been seeking to convince Armstrong to come forward to clear his conscience and spare the organization from further damage, the Times reported, citing a person with knowledge of the situation.

But an official with Livestrong said the group was unaware of any pressure on Armstrong by organization donors to admit anything, and declined to comment further.

Calls to Armstrong's attorney and Capital Sports & Entertainment, which represents Armstrong, were not returned on Saturday.

Austin, Texas-based Livestrong was launched in 2003 by the Lance Armstrong Foundation, which the cyclist founded in 1997, a year after he was diagnosed with testicular cancer. In October, he stepped down from his post as chairman of the board, saying he did not want the doping controversy to affect the organization. A few weeks later, he quit the board outright.

World Anti-Doping rules permit under certain circumstances penalties for admitted dopers to be reduced.
