The Politics of ?Discovery? - The Society Pages
For the last week of December, we?re re-posting some of our favorite posts from 2012.
We often hear that Christopher Columbus ?discovered? America, a word that erases the 50 million-plus inhabitants of the continent that were already here when his boat arrived. A person can?t discover something that another person already knows about. ?In the American telling of the story, however, the indigenous population don?t count as people. They?re knowledge isn?t real.
This dismissal of knowledge-of-a-thing until the ?right? people know about it is a common tendency, and another example was sent in by Jordan G. last week. ?CNN, ABC, CBS, and the Los Angeles Times, among other news outlets, reported that a new species of monkey was ?discovered.???
So where did they find this monkey? ?Tied to a post in a Congolese village; it was a pet. ?
And it was cuuuuuuuuuuuuuuuute!
So someone knew about these monkeys. ?It just wasn?t the right kind of person. ?In this case, the right kind of person was a (bonafide) scientist (with credentials and institutional privileges not un-related to living in the West).
Now I?m not saying that it doesn?t matter that a trained scientist encountered the monkey and established it as a unique and previously undocumented species. ?The team did a lot of work to establish this. ?As the Times, which otherwise does a fine job on the story,?explains:
Convinced the species was novel, team leader John Hart began an exhaustive three-year study to describe the monkey, and to differentiate it from its nearest neighbor, the owl face monkey. The study included geneticists and biological anthropologists, who helped confirm that the monkey was different from the owl face, though the two share a common genetic ancestor.
In other words, something significant happened because those scientists happened upon this monkey. ?But to say that they ?discovered? it is to mischaracterize what occurred. The scientists write that it was ?previously undescribed,? which is far more accurate. Their language also?doesn?t?erase the consciousness of the people of the Congo, where this monkey is ?endemic.? ? In fact, they recommend the short-hand name ?lesula,? ?as it is the vernacular name used [by people who've known about it, probably for generations] over most of its known range.? ?In doing so, they acknowledge the species? relationship to a population of human beings, making them visible and significant.

Former President Bush moved out of intensive care
HOUSTON (AP) ? Former President George H.W. Bush's condition continued to improve Saturday, prompting doctors to move him out of intensive care, a spokesman said.
"President Bush's condition has improved, so he has been moved today from the intensive care unit to a regular patient room at The Methodist Hospital to continue his recovery," family spokesman Jim McGrath said Saturday. "The Bushes thank everyone for their prayers and good wishes."
Bush was hospitalized Nov. 23 for treatment of a bronchitis-related cough. He was moved to intensive care at the Houston hospital on Dec. 23 after he developed a fever.
On Friday, McGrath said Bush had improved since arriving in the ICU. He said he was alert and in good spirits and was even doing some singing.
McGrath said Saturday morning that future updates on Bush's condition would be made as warranted.
Bush, the 41st president, is the country's oldest living former president by a few months.

What is a limited liability corporation?
A limited liability corporation is just another name for a limited liability company. A limited liability company, which is also called an LLC, is a business
structure that combines the pass through taxation of a partnership or sole proprietorship with the limited liability of a corporation.
Like the owners of a partnership or sole proprietorships the LLC owners have to report their business profits or losses on their personal income tax returns because the LLC is not a separate taxable entity. But unlike these owners if you own an LLC you are not personally responsible for the business debts and claims, you are protected from any personal liability unless you have given a personal guarantee, this is what is known as limited liability. Basically what this boils down to is that if somebody sues the LLC then only the assets of the business itself are at risk, your personal assets are considered safe. But what you want to keep in mind is that you can lose this protection of your assets if you act illegally, unethically, or irresponsibly.
But it is because of these features that many people say that a limited liability company is nothing more than a hybrid business structure that takes the best features of a partnership and a corporate business structure. Meaning this business structure combines these two forms of business, but only uses the best features from each form.
How many people do I need to form an LLC?
Many people wonder how many people you need to form a LLC because of the fact that it combines various business structures. The good news is that you only need one person to form an LLC and you can form an LLC in any state. But you can also have more than one owner when forming an LLC.
Who should form an LLC?
If you are concerned about personal exposure to lawsuits or debts arising from your business than you should seriously think about forming an LLC. A great example of this would be if you were opening up a store front business that deals directly with the public you might be worried about your commercial liability insurance not fully protecting your assets from customers suing you from slipping and falling or something else. So by forming an LLC your personal assets are protected from these types of claims and any others.
But something that you want to keep in mind before you decide to form an LLC is that not all business can operate as an LLC. Businesses that are in the banking, trust and insurance industry are generally prohibited from forming LLC?s in every state. Also in some states, including CA, there is a rule that prohibits professionals, such as accountants, doctors, architects and other professionals from forming an LLC. So if you are considered to be some kind of professional you want to check into your state laws to see if you can form an LLC or not.
How do you form an LLC?
This is going to vary depending on which state that you live, but for the most part this is a pretty universal process. All that you really need to do is to file an ?Articles of Organization? with your state?s LLC filing office. In most states this filing office is going to be a part of the Secretary of State?s Office. But in addition to filing the ?Articles of Organization? you are going to have to pay a filing fee. Keep in mind that some states refer to these forms as a ?Certificate of Organization? or a ?Certificate of Formation?. But no matter what it is referred to most states will provide a fill in the blank form for you to use and these only take a few minutes to prepare. You can get this form by mail or by downloading it from your state?s website, in the Secretary of State or corporation?s home page.
Some states will also require you to publish your intention to form an LLC in your local newspaper. The states that require this also require that you complete this step before you file your Articles of Organization. Some states, but not very many, will also require you to prepare an LLC Operating Agreement. And even if it is not required in your state it is still a good idea to prepare one. The reason that you want to do this regardless of your state requirements is because your Operating Agreement is going to spell out your business arrangements and it will also decide how your LLC is run. If you fail to create a written Operating Agreement then the LLC laws of your state will dictate how your LLC is run.
Do I need a lawyer to form an LLC?
The good news is that you do not need to have a lawyer to form an LLC, but if you want to use one you can. The reason that you don?t need to hire a lawyer is that the information that is required for the Articles of Organization is all non-technical information so it is easy enough for you to fill out on your own. Basically what the Articles of Organization include are the name of the LLC, the location of its main office, the names and addresses of the owners, and the name and address of the LLC?s registered agent. The registered agent is a person or company who agrees to accept legal papers on behalf of the LLC. Not to mention that since most states now provide downloadable forms and instructions the process to file for an LLC is even easier and the LLC offices even allow business owners to email them questions directly.
Does my LLC need an operating agreement?
This is not required by all states, but it is something that you should do if you plan on starting a business. Here are the main reasons why an operating agreement is necessary:
- Ensures that the courts will respect your personal liability protection because you are showing them that you have been conscientious about organizing your LLC
- Helps to avoid misunderstandings among the owners over finances and management
- Sets out the rules that govern how the profits will be split up, how major business decisions will be made, and the procedures for handling the departure and addition of members
- Allows you to create your own operating rules rather than being governed by the default laws in your state. Which these state laws might not work to your benefit
How are LLCs taxed?
LLCs are not considered a separate entity from its owners for tax purposes. So this means that an LLC does not pay any income taxes itself. Instead what happens is that the owners of the LLC pay taxes on their allocated share of profits or they get to deduct their share of business losses on their personal tax returns. But the thing with an LLC is that you can choose how you want it to be taxed, so you can also choose to have your LLC taxed like a corporation. This can be useful because it can reduce taxes for LLC owners who need to retain a large amount of profits in the company.
Can I convert my existing business to an LLC?
The good news is that yes you can convert your business to an LLC. In fact converting a sole proprietorship or a partnership is an easy way for the business owners to protect their personal assets without changing the way that their business income is taxed. And some states even provide a simple form for converting a partnership to an LLC; this form is usually called a ?Certificate of Conversion?. If your state does not provide this form then you will need to file regular Articles of Organization to create an LLC.
And just like in forming an LLC some states require a partnership to publish a notice in the local newspaper that the partnership is being terminated before the partnership can officially convert to an LLC. But no matter what state you live in you are going to have to transfer all identification numbers, licenses, and permits to the name of your new LLC. Some other things that you will need to transfer over are:
- Federal identification number
- State employer identification number
- Sales tax permit
- Business license or tax registration
- Any professional licenses or permits
What are the differences between a limited liability company and a partnership?
The biggest difference between an LLC and a partnership is that in an LLC the owners are not personally liable for the company?s debts and liabilities. What this boils down to is that creditors cannot go after the owners? personal assets to pay off the businesses? debts. And the only way that this can happen in a partnership is if the partner is designated as a ?limited? partner in the partnership agreement. Another big difference is that when you are forming a partnership you do not need to file any formal paperwork or pay any special fees.

President Obama calls on Congress to protect tax cuts for the middle class
Echoing Friday's challenge to Congress to reach a deal on the fiscal cliff, President Obama uses this week's radio address to call on them to protect middle class tax cuts:
But we?re now at the point where, in just a couple days, the law says that every American?s tax rates are going up. Every American?s paycheck will get a lot smaller. And that would be the wrong thing to do for our economy. It would hurt middle-class families, and it would hurt the businesses that depend on your spending.And Congress can prevent it from happening, if they act now.
And the president again dared House and Senate Republicans to continue their hostage taking of the economy and American paychecks:
But if an agreement isn?t reached in time, then I?ll urge the Senate to hold an up-or-down vote on a basic package that protects the middle class from an income tax hike, extends vital unemployment insurance for Americans looking for a job, and lays the groundwork for future progress on more economic growth and deficit reduction.Make a deal or have an up or down vote ... or be the Party solely responsible for a tax hike for every American. ?I believe such a proposal could pass both houses with bipartisan majorities ? as long as these leaders allow it to come to a vote. You meet your deadlines and your responsibilities every day. The folks you sent here to serve should do the same. We cannot let Washington politics get in the way of America?s progress. We?ve got to do what it takes to protect the middle class, grow this economy, and move our country forward.

U.S. stocks cut most losses; yen hits two-yr low
NEW YORK (Reuters) - U.S. stocks recovered from sharp losses to end only slightly lower on Thursday after the U.S. House of Representative said it would come back to work this weekend in a last-ditch effort to avoid the "fiscal cliff," while the yen hit a two-year low on expectations of bold monetary stimulus in Japan.
It was a fourth straight session of losses for U.S. stocks, while world stocks ended slightly higher.
Wall Street stocks tumbled in morning trade after Senate Majority Leader Harry Reid, the top Senate Democrat, said the United States may be poised to go off the "fiscal cliff." But in late trading, the House of Representatives said it set a work session for Sunday night ahead of the December 31 deadline for reaching a deal, paring losses that earlier that earlier had driven all three major stock indexes down about 1 percent.
Economists warn that the $600 billion in higher taxes and spending cuts set to kick in from January could push the world's largest economy into recession, dragging other countries with it.
"There's no conviction in the move or the overall market, based on the across-the-board reduction we've seen in volume ... but there will be continued weakness until there's sustained positive direction coming from our leaders," said Joseph Cangemi, managing director at ConvergEx Group, in New York.
The House of Representatives may stay in session until January 2, the final day of the current Congress, according to a Twitter message from House Majority Leader Eric Cantor.
That is the day that another component of the "fiscal cliff" - $109 billion in automatic spending cuts to military and domestic programs - is set to start.
The Dow Jones industrial average dipped 18.28 points, or 0.14 percent, to end at 13,096.31. The Standard & Poor's 500 Index was down 1.74 points, or 0.12 percent, at 1,418.09. The Nasdaq Composite Index was down 4.25 points, or 0.14 percent, at 2,985.91.
Shares of U.S. retailers fell for a second day following the Christmas holiday. The Morgan Stanley retail index was down 0.2 percent.
The MSCI global index was last up 0.1 percent, while European shares ended down 0.01 percent.
President Barack Obama returned to Washington on Thursday, cutting short his holiday to try to get a budget deal with Republican lawmakers.

The dollar rose to 86.15 yen on Reuters data, its highest since mid-August 2010. It was last up 0.5 percent at 86.02 yen.
The dollar has risen 12 percent against the yen in 2012, on track for its biggest annual gain since 2005. Yen selling has accelerated in the past two months on expectations that Shinzo Abe would be elected prime minister and would pursue policies to weaken the Japanese currency.
The Liberal Democratic Party won the elections on December 16, making Abe the prime minister. Since then, he has kept up pressure on the Bank of Japan to attack deflation and weaken the yen.
"If everyone is simply going to take Mr. Abe at his word, then we can go a lot further before this move is done," said Kit Juckes, strategist at Societe Generale in London.
The euro rose 0.2 percent to $1.3242.

Obama says immediate action needed on fiscal cliff
WASHINGTON (AP) ? President Barack Obama says "the hour for immediate action is here" on a deal to avert the fiscal cliff.
The president says he remains "optimistic" that an agreement can be reached in Congress before a looming year-end deadline to avoid tax increases and spending cuts.
If Congress can't reach a deal, the president says Congress should allow a vote on a basic package that would preserve tax cuts for middle-class Americans while extending unemployment benefits for the long-term jobless and working toward a foundation for a broader deal.
The president says an hourlong meeting Friday with congressional leaders was "good and constructive."
Senate leaders say they hope to reach a compromise that could be presented to lawmakers by Sunday, little more than 24 hours before the deadline.

Denton County Firefighter Dies From Brain Cancer ? CBS Dallas ...
DENTON (CBSDFW.COM) ? Mike Bell, a 19-year veteran of the Denton Fire Department, died Sunday evening after battling a rare form of brain cancer.
Bell, who suffered from gliosarcoma brain cancer, served as a Denton firefighter and paramedic for 19 years and would have celebrated his 20th anniversary with the department at the end of January.
In November, Denton firefighters rallied to shave their heads in support of their comrade to raise money for his medical expenses.
?You don?t get a better brotherhood than the fire department. These guys are great,? Bell told CBS 11 News just before he took a razor to his friends last month.
Bell lost his hair after his first round of chemotherapy in January. He underwent four rounds of chemotherapy and four surgeries in all.

Whale dies after getting stranded on NYC beach

NEW YORK -- An emaciated 60-foot finback whale that washed up on a coastal community devastated by Superstorm Sandy has died, marine officials said Thursday.
The whale was found beached on Wednesday in Breezy Point, Queens, where more than 100 homes burned down and more than 2,000 were damaged during the Oct. 29 storm. It was carried out at high tide but washed ashore another time on Thursday, where marine officials said they found it dead, according to media reports.
?Biologists have confirmed that the whale has died,? Mendy Garron, a marine mammal rescue specialist with the National Oceanic and Atmospheric Administration (NOAA), told Reuters. ?Plans are currently being developed for necropsy and disposal of the carcass."

Finback whales are an endangered species. They are second in size only to the blue whale, and can reach up to 70 feet in length and weigh up to 70 tons. The whales migrate to equatorial waters in the fall and during winter, they mostly fast, surviving on their fat reserves. Winter is also when they mate, and calves are born one year later, according to the New York State Department of Environmental Conservation.
It is one of the fastest large whales and can stay underwater for up to 50 minutes off of one breath.
Rob DiGiovanni, executive director of the Riverhead Foundation for Marine Research and Preservation told NBC New York on Wednesday that the whale was ?severely emaciated? and ?underweight. The outcome does not look good.?
Calls placed Thursday seeking comment to the foundation and NOAA were not immediately returned.
The whale was found on the bay side of the community, which is tucked in by the Atlantic Ocean and Jamaica Bay. With most homes rendered uninhabitable by the storm, many residents have had to move away and make daily trips to continue repairs.
Breezy Point, a private cooperative, was founded more than a century ago by Irish immigrants.

Hacker allegedly leaks Verizon FiOS customer data, Big Red points the finger at marketing firm
Verizon customers saw a flash of excitement this weekend when an alleged hacker claimed to have pilfered personal data for some three million of its wireless customers. Twitter user TibitXimer shared 300,000 names from the file, claiming to have collected them as early as July 12th. According to Verizon, the would-be hacker's claims are bunk -- the leaked data has been available for months, and it's populated by Verizon FiOS customers. More importantly, Verizon says that its servers weren't hacked at all.
"There was no hack, and no access gained," it said in a statement to The Next Web "A third party marketing firm made a mistake and information was copied." Verizon says the leak was reported to authorities months ago, and insists that recent claims are inaccurate and exaggerated. Sure enough, security researcher Adam Caudill recalls seeing the file back in August, guessing this is probably a file leaked from a telemarketing agency. Either way TibitXimer's account has vanished from the social network, demonstrating, if nothing else, that Twitter is serious about its Trust & Safety policies.

They found that telomeres, molecular caps that protect the ends of the chromosomes, move to the outer edge of the cell's nucleus after they have been duplicated.
While the implications of this spatial reorganization of telomeres are not yet clear, the findings may shed light on how our genes are regulated and how gene expression programs are altered during cell division, an important step in understanding aging and diseases that stem from genetic mutations, such as cancer.
"What we discovered is that telomeres not only protect our chromosomes, they also help organize our genetic material in the nucleus," says Jan Karlseder, a professor in Salk's Molecular and Cell Biology Laboratory and the Donald and Darlene Shiley Chair. "This is important, because the three-dimensional position of DNA in the nucleus influences gene expression profiles and how the genome morphs over time."
Telomeres, a combination of proteins and DNA, are crucial in DNA replication, tumor suppression and aging. Every time a primary human cell divides, its telomeres get shorter, until critically short telomeres lead cells to self-destruct. Much of Karlseder's research has focused on understanding telomere dynamics in order to develop ways to influence the aging process, and as a result, restrict cancer cell growth.
In addition to exploring the involvement of telomeres in premature aging diseases and interactions between the DNA damage machinery and telomeres, Karlseder studies the role of telomeres during the cell cycle. Previous studies on human cells have shown that telomeres change positions during cell division, suggesting they might also play a role in organizing DNA in the nucleus. But these studies provided only isolated snapshots of telomeres at various stages of the cell cycle.
In their new study, the Salk researchers used advanced time-lapse live-cell confocal microscopy to track telomere movement in real time throughout the cell cycle. They followed the telomeres for 20 hours in living cells by labeling them with molecules that glowed under the microscope. They also recorded the movement of chromatin, a combination of DNA and proteins that forms chromosomes.
The scientists found that the telomeres moved to the outer periphery of the nuclear envelope of each daughter cell nucleus as they assemble after mitosis, the stage of cell division during which the cell's DNA is duplicated to provide each daughter cell with its own copy. By exploring the underlying molecular pathways, the researchers determined that interactions between two proteins, RAP1 and Sun1, seem to tether the telomeres to the nuclear envelope. Sun1 alone was also capable of attracting the telomeres to the nuclear envelope, suggesting the protein is essential for the process and that other elements might be able to replace RAP1 during tethering.
"The tethering of telomeres to the nuclear envelope may serve as an anchor point to reorganize chromatin after each cell division, so that our DNA is correctly situated for gene expression," Karlseder says. "This tethering could also play a role in the maintenance of telomeres, thereby influencing aging, cancer development and other disorders associated with DNA damage. We plan to explore these possibilities in future experiments."
